Failing to Plan Invites War

When I was a young attorney, I feared running out of cases. Even when I had partners, I had that fear. Even now, I can wake up in a cold sweat over the class I forgot to finish in college (at least in my nightmare), or that last file that gets closed and shredded. How will I provide for my daughter?

But everyone takes care of me. Because we don’t plan for the Probate War. Even though the Probate War is as predictable as the change of seasons, most of us simply won’t plan. The price of that failure will keep me busy, and my daughter’s bills paid. So I’m a busy, seasoned warrior.

An increasing number of us will live deeply into incapacity. Plus, we will all die. Those facts assure me of estate fights due to others who decided to write their own Wills (if they even have one), or any number of others who either didn’t know or didn’t care that death is certain, and war often follows.

I assure the world that my business will still grow if you plan for the inevitability of incapacity and death. Call me for a $300.00 Will planning package (or a package tailored to your needs and desires), or someday your family may pay me $250.00 an hour to settle the ashes of your war. Choose the former, and know these benefits:

Have a Lawyer Draft your Will: If you have a will, you limit Court control of your estate, and dictate the disposition of your estate. You’ll also save at least half the lawyer’s fees necessary to settle the estate. Last, almost all Wills drawn by lawyers are done right and never contested. But as for you do-it-yourselfers . . . I desire that my daughter attend an Ivy League school, so I thank you in advance for your contribution.

Get Powers of Attorney: Avoid a guardianship. Pay a lawyer to draw your Powers of Attorney, not a computer programmer. You’ll save thousands of dollars, and unmentionable heartache to the family that waits by your bedside.

Resolve the Schiavo Scenario: Ultimately, who knows what you want if you don’t have an attorney draw a Living Will for you? The insurance beneficiary? You need a Living Will, and no, not from a computer programmer or internet site.

And just to be clear: What do you want to happen with your organs, body or ashes? Tell us while you can. Ted Williams head was ultimately frozen, Terri Schiavo’s body was ultimately sent away, but lots of lawyers got fatter in the interim.

Three universal truths: 1). We die; 2). War may follow; 3). We should plan accordingly.
